Welcome to Kavalu! These Terms of Service ("Terms") are provided by Urban Folklore Ltd and govern your use of our AI-powered learning assistant, including our Chrome extension and web application. By using Kavalu, you agree to these Terms.

By accessing or using Kavalu, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

These Terms apply to all users of Kavalu, including visitors, registered users, and subscribers to our services.

2. Description of Service

Kavalu provides:

• Chrome Extension: Professional AI reading assistant that transforms web content into structured knowledge
• AI-Powered Analysis: Instant explanations, summaries, and contextual Q&A for complex business and technical content
• Smart Flashcards: Automatic generation of learning materials with one-click creation and Anki export
• Multimodal Intelligence: Process text and images together for comprehensive document understanding
• Multi-Language Support: Translation and explanations across multiple languages for international professionals
• Text-to-Speech: Professional voice synthesis for audio learning (Pro tier)
• Full Page Analysis: Process entire research papers and lengthy reports (Pro tier)
• Privacy-Focused Design: Transient content processing with no server-side storage of your selected text

3. Account Registration and Security

3.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain and update your information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access

3.2 Account Responsibility

You are responsible for all activities that occur under your account. Kavalu is not liable for any loss or damage arising from your failure to maintain the security of your account.

4. Acceptable Use Policy

You may use Kavalu for:

• Research and knowledge acquisition
• Creating study materials for personal use
• Sharing flashcards with other Kavalu users (when available)

4.2 Prohibited Use

You may NOT use Kavalu to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Generate harmful, offensive, or inappropriate content
• Attempt to reverse engineer or hack our services
• Resell or commercially distribute generated content without permission
• Overwhelm our servers with automated requests
• Impersonate others or create fake accounts

5. Intellectual Property Rights

5.1 Kavalu's Property

The Kavalu service, including its software, design, and content (excluding user-generated content), is owned by Kavalu and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

5.2 Your Content

You retain full ownership of the flashcards and notes you create. These are stored locally on your device only. We do not store, access, or have any rights to your created content.

5.3 Third-Party Content

When you use Kavalu to process content from websites, you are responsible for ensuring you have the right to use that content in accordance with the website's terms of service and applicable laws.

6. AI Services and Accuracy Disclaimer

Please understand that:

• AI explanations are generated automatically and may not always be accurate
• Content should not be relied upon for critical decisions
• Medical, legal, or financial advice should be obtained from qualified professionals
• We do not guarantee the accuracy, completeness, or usefulness of AI-generated content
• You use AI-generated content at your own risk

7. Subscription and Billing

7.1 Free Tier

Kavalu offers a free tier with limited features. Free tier limitations may change at our discretion.

7.2 Premium Subscriptions

Premium subscriptions provide:

• 2,000 credits per month for AI features
• Advanced flashcard features
• Priority support
• Additional export formats

7.3 Payment Terms

• Subscriptions are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• You authorize us to charge your payment method automatically
• Price changes will be notified 30 days in advance

7.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

8. Privacy and Data Protection

Your privacy is important to us. Our use of your personal information is governed by ourPrivacy Policy, which is incorporated into these Terms by reference.

• Flashcards are stored locally on your device only
• You can export or delete your local data at any time
• We only store your language preference on our servers

9. Limitation of Liability

In no event shall Kavalu's aggregate liability exceed the amount you paid to Kavalu in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Kavalu, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you create or share through Kavalu

11. Modifications to Service and Terms

11.1 Service Changes

We reserve the right to modify, suspend, or discontinue any part of our service at any time. We will provide reasonable notice for significant changes that materially affect your use of the service.

11.2 Terms Updates

We may update these Terms from time to time. We will notify you of material changes via email or through the service. Your continued use after changes constitutes acceptance of the updated Terms.

• You may request export of your data within 30 days
• We may delete your data after 30 days

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kavalu.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights to any successor or acquirer.
